3. Services Description
Luminous Quay provides smart home technology solutions including:

4. Eligibility
To use our services, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into binding contracts

- Be the owner or have authority to authorise installations at the property
5. Service Agreement and Installation
5.1 Quotations
All quotations are valid for 30 days unless otherwise specified. Quotations are based on information provided by the customer and may be subject to change following site survey.
5.2 Contracts
Service contracts become binding upon:
- Written acceptance of our quotation by the customer
- Receipt of any required deposit
- Successful completion of any necessary site surveys
5.3 Installation Access
Customers must provide reasonable access to the property for installation, maintenance, and service activities. Any delays caused by lack of access may result in additional charges.
6. Pricing and Payment
6.1 Pricing
All prices are quoted in British Pounds (GBP) and include VAT where applicable. Prices may vary based on:
- Complexity of installation
- Property size and layout
- Selected equipment and features
- Additional customisation requirements
6.2 Payment Terms
- Deposit: 50% of total project cost required before work commences
- Progress payments: As specified in individual contracts
- Final payment: Due within 7 days of project completion
- Ongoing service fees: Payable monthly or annually as agreed
6.3 Late Payment
Late payment charges of 1.5% per month may apply to overdue amounts. We reserve the right to suspend services for accounts more than 30 days overdue.
7. Warranties and Guarantees
7.1 Installation Warranty
We warrant our installation workmanship for 24 months from completion date. This warranty covers:
- Defects in installation workmanship
- System configuration errors
- Integration failures between components
7.2 Equipment Warranty
Smart home equipment is covered by manufacturer warranties, typically 12-60 months depending on the product. We will facilitate warranty claims on behalf of customers.
7.3 Warranty Exclusions
Warranties do not cover:
- Damage caused by customer misuse or negligence
- Normal wear and tear
- Damage from power surges or natural disasters
- Unauthorised modifications or repairs
- Software issues beyond our control
8. Customer Responsibilities
Customers are responsible for:
- Providing accurate property and requirement information
- Ensuring stable internet connectivity for smart devices
- Maintaining appropriate power supply to installed systems
- Following provided user instructions and safety guidelines
- Promptly reporting any system issues or malfunctions
- Allowing access for scheduled maintenance and support
- Keeping system passwords and access credentials secure
9. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability for any claim shall not exceed the amount paid for the specific service giving rise to the claim
- We are not liable for indirect, consequential, or punitive damages
- We are not responsible for third-party equipment failures or software issues
- Our liability for data loss or security breaches is limited to reasonable restoration efforts
Nothing in these Terms excludes or limits our liability for death, personal injury, fraud, or statutory consumer rights that cannot be excluded by law.
10. Privacy and Data Protection
Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms. By using our services, you consent to the collection and use of information as described in the Privacy Policy.
11. Intellectual Property
All content on our website and proprietary system configurations remain our intellectual property. Customers receive a limited, non-transferable license to use our services. Customers may not:
- Reproduce or distribute our proprietary materials
- Reverse engineer our custom software or configurations
- Use our trademarks or branding without permission
- Share access credentials with unauthorised parties
12. Cancellation and Termination
12.1 Customer Cancellation
Customers may cancel services with the following conditions:
- Before work begins: Full refund minus 5% administrative fee
- After work begins: Charges apply for work completed and materials ordered
- Ongoing services: 30 days written notice required

We may terminate services for:
- Non-payment of fees
- Breach of these Terms
- Unsafe or unlawful activities
- Abusive behaviour towards staff
13. Force Majeure
We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including but not limited to:

- Government actions or regulations
- Labour disputes or strikes
- Supply chain disruptions
- Pandemic or public health emergencies
14. Dispute Resolution
14.1 Initial Resolution
We encourage customers to contact us directly to resolve any disputes. We will make reasonable efforts to address concerns promptly and fairly.
14.2 Mediation
If direct resolution is unsuccessful, disputes may be resolved through mediation by a mutually agreed mediator.
14.3 Legal Action
Any legal proceedings must be brought in the courts of England and Wales. These Terms are governed by English law.
15. Consumer Rights

16. Modifications to Terms
